Personal Injury: ATV Accident

ATV Accidents

ATV :: Yamaha Rhinos :: UTV

The Yamaha Rhino ATV was developed by Yamaha as a side by side ATV and introduced in 2003. It is also referred to as a utility terrain vehicle (UTV).

Unfortunately, potential Yamaha Rhino ATV design problems may cause the vehicle to be very unstable and prone to rollover (ATV rollovers or rhino rollover accidents) or crash which may cause serious and/or life threatening injuries to the users (broken legs, broken arms, head injuries, crushed legs and arms and death).

YAMAHA RHINO ATV: POSSIBLE ROLLOVER DESIGN PROBLEMS

The Yamaha Rhino ATV appears to be very top heavy and sits on a narrow frame which may contribute to rhino rollovers or accident.

There have been reports that rollovers of Yamaha Rhino ATVs have been observed at speeds as low as 13 miles per hour and may rollover more frequently than other side by side ATV’s.

The ATV vehicle was initially sold without any doors, leaving the legs of drivers and passengers unprotected. In September 2006, Yamaha sent a letter to Rhino ATV owners about the Yamaha Rhino ATV problems, which included information about what a user should do if the ATV tips over.

In many cases, users of the Yamaha Rhino ATV have suffered broken arms, ankles and legs, including severe fractures and crush injuries, when the occupants' arms or legs came out of the vehicle as it rolled over.

U.S. Consumer Product Safety Commission (CPSC)

In addition, the U.S. Consumer Product Safety Commission (CPSC), in cooperation with Yamaha Motor Corp. U.S.A., of Cypress, Calif., announced on March 31, 2009, a free repair (recall) program to address safety issues with all Rhino 450, 660, and 700 model off-highway recreational vehicles.

Additionally, the U.S. Consumer Product Safety Commission (CPSC), (via its website ) reported that in 2006 there were more than 146,00 emergency room treated ATV injuries and at least 750 ATV related deaths reported in the U.S. The CPSC website is a great resource for information on ATV's.

An MDL has been setup in the Western District of Kentucky for Yamaha Motor Corp. Rhino ATV Products Liability Litigation (Rollover) (IN RE: Yamaha Motor Corp. Rhino ATV Products Liability Litigation No. 2016).
